Embertec commences Federal Court proceedings against Energy Efficient Technologies Pty Limited

 On 14 August 2012 Embertec commenced proceedings in the Federal Court against Energy Efficient Technologies Pty Limited, and its director, alleging:

–    infringement of its registered trade mark no.1271564;

–    breach of copyright in respect of materials created for use by Embertec in its user guides and manuals, and

–    certain misleading and deceptive conduct.

On 14 August 2012, on Embertec’s application, the Federal Court made orders for short service on Energy Efficient Technologies Pty Limited, details of which are set out as follows.

On 21 August 2012 orders were made by the Federal Court, by consent, in respect of the further conduct of the matter, and the Court noted that on the basis that Embertec proffered to the Court the usual undertakings as to damages, Energy Efficient Technologies Pty Limited and its director gave undertakings in relation to certain copyright works, and Energy Efficient Technologies Pty Limited gave an undertaking in relation to the making of specified representations, details of which orders and undertakings are set out as follows.
